Refund Policy

This policy applies to the one-time purchase of a personalised PenguinKit development guidance kit for one project. PenguinKit is operated by AFAXON (“we” or “us”). Lemon Squeezy is the merchant of record for the purchase transaction.

Cancellation and change of mind

You may request a full refund before kit generation begins. Once a usable kit that conforms to the purchase description has been prepared and made available for download, we do not offer a voluntary change-of-mind refund, including where you no longer require the kit or decide not to proceed with the project.

If generation has begun but a usable kit is not yet available, we assess a cancellation or refund request in light of the fulfilment status, this policy, applicable legal rights and Lemon Squeezy’s terms. Starting generation does not itself result in automatic refusal of a refund.

This restriction applies only to voluntary change-of-mind refunds. It does not exclude remedies for non-delivery, defects or material discrepancies from the purchase description, any statutory cancellation or withdrawal right, or a refund authorised by Lemon Squeezy.

Delivery problems and material defects

If payment has been taken but you cannot access the paid project, receive a usable kit or download the ZIP, contact us with details. The same applies if the supplied kit has a material defect or materially fails to match its advertised description. We will investigate and seek to remedy the problem. If we cannot supply the purchased kit as described, we will arrange a refund through Lemon Squeezy. Any repair or replacement process remains subject to the remedies and time requirements of applicable law.

The product is a development guidance kit. A lack of success in building an application from it does not by itself establish a delivery defect. This does not excuse a defect in the kit or limit your statutory rights. Duplicate charges for the same purchase will be investigated and any confirmed duplicate payment corrected.

Submitting a request

Email info@penguinkit.com using the account or purchase email address where possible. Include the order number, if available, and describe the request or problem. We may request information reasonably necessary to identify the purchase and assess the issue. Do not send payment card numbers, passwords or other credentials.

Approved refunds are processed by Lemon Squeezy through the applicable payment method. The time for a refund to appear depends on the payment provider and your bank; we do not guarantee a bank processing time. You may also contact Lemon Squeezy about the transaction under its Buyer Terms. Lemon Squeezy may issue refunds at its discretion under its refund and chargeback policy.

Statutory cancellation and consumer rights

Consumers in some jurisdictions, including the European Economic Area and the United Kingdom, may have a statutory cancellation or withdrawal period for an online purchase. Where an exception for immediate supply of digital content requires prior express consent, acknowledgement of the loss of the withdrawal right and confirmation of that agreement, the exception applies only if the applicable legal requirements are met. A personalised kit, a generation request or the availability of a download does not by itself remove a statutory right.

To exercise an applicable cancellation or withdrawal right, send a clear statement of your decision to cancel to the contact details in this policy or use the transaction support channel provided by Lemon Squeezy. Nothing in this policy restricts any additional method or remedy available under applicable law.

Effect of a refund

A refunded purchase no longer grants access to its paid kit downloads or remaining included updates and decision help. Information may be retained as described in the Privacy Policy. Your applicable consumer rights remain unaffected.
