Using PenguinKit

Terms of Use

PenguinKit is operated by AFAXON (“we” or “us”). These terms govern access to and use of PenguinKit and the development guidance we supply. Please review them before using the service or making a purchase.

The service and purchase

Each verified account is eligible for one complete free trial project, including planning and downloadable project documents. The trial uses a lower-cost AI model and may produce less accurate or consistent recommendations than the Premium model. Trial access is assigned to one selected project; retries and included updates continue within that project and do not create an additional allowance. Deleting a project does not restore the allowance. Premium purchases use a more capable model but do not guarantee error-free results. All guidance requires independent review before implementation.

The price is $39 USD as a one-time payment for one project, with any applicable taxes shown at checkout. The purchase does not renew automatically. It includes guided project questions, up to 20 successful decision-help requests, one initial personalised Markdown development kit and up to two kit updates for the same project. Required project questions do not count against the decision-help allowance. Unsuccessful preparation attempts do not count as delivered kit versions.

The kit is supplied as a private downloadable ZIP containing project requirements, suggested architecture, coding guidance and build instructions based on the project information and decisions you review. You must complete the necessary project information and review steps before preparation. The purchase supplies development guidance; it does not include application development, deployment, hosting, third-party subscriptions or professional legal advice. Costs of implementing and operating your project are separate.

Accounts and responsibilities

You must be legally able to enter into these terms. If you use PenguinKit on behalf of an organisation, you must have authority to act for it. Provide accurate account and purchase information, protect your sign-in credentials and notify us of suspected unauthorised access. You are responsible for the information you submit and for ensuring that you are entitled to share and process it through the service.

Your content and permitted use

You retain any rights you hold in your project descriptions, answers and uploaded briefs. You authorise AFAXON and its service providers to process, reproduce and store that material as necessary to provide the service, as described in the Privacy Policy.

Your purchase permits you to use, copy and modify the supplied kit to develop the project covered by that purchase, including sharing it with team members and contractors working on that project. You may not resell, republish or distribute the kit as a standalone product. This permission does not transfer ownership of PenguinKit branding or service materials, and any third-party materials remain subject to their applicable rights. AI-generated material may not be unique or eligible for exclusive intellectual property protection.

Acceptable use

Do not submit unlawful content, infringe another person’s rights, disclose confidential information without authority, misuse another person’s account, circumvent access controls or usage limits, or interfere with the service. Omit passwords, API keys, payment credentials and unnecessary sensitive personal information from project content.

AI guidance and your decisions

AI-generated recommendations may contain errors, omissions or unsuitable assumptions. Review the kit, resolve outstanding decisions and obtain qualified advice where the subject requires it. You remain responsible for implementation choices, testing, security and compliance of anything built from the guidance. PenguinKit does not guarantee a particular result from an AI coding tool, developer or completed project. These qualifications do not remove our obligation to provide the purchased service as described or affect remedies available under applicable law.

Payments and refunds

Lemon Squeezy acts as merchant of record and handles payment, applicable transaction taxes, refunds and payment disputes. Its Buyer Terms apply to the purchase transaction. The total amount is presented before payment. Our Refund Policy describes voluntary refunds, delivery remedies and the effect of a refund. Mandatory consumer rights and Lemon Squeezy’s authority under its applicable terms remain unaffected.

Access and availability

Purchased kits are available through the associated account, subject to a valid purchase and the retention arrangements in the Privacy Policy. Download and retain your own copy of the ZIP. Maintenance, technical faults or provider interruptions may temporarily affect access. If a purchased kit cannot be prepared or downloaded, contact support for assistance and the remedies described in the Refund Policy.

Protection of the service

We may restrict access where reasonably necessary to address security risks, unlawful use or a material breach of these terms. Where practicable, we will explain the reason and provide an opportunity to resolve it. Any restriction remains subject to applicable law and does not remove statutory remedies relating to a purchase.

Applicable law and consumer rights

These terms are governed by the laws of Pakistan, subject to any mandatory protections that apply in your place of residence. Nothing in these terms excludes rights or liability that applicable law does not permit us to exclude, or prevents you from bringing a claim before a court with jurisdiction under that law. Please contact us first if you wish to raise a service or purchase concern.

Changes to these terms

Revised terms will be published here with an updated date. Changes will apply prospectively and will not retrospectively reduce the kit, included allowances or remedies promised for an existing purchase without your agreement, except where required by law. Additional notice or consent will be provided where applicable law requires it.
